"Wide Glide" Sirk is up to mischief again. This morning, Sirk filed
an amended petition against the Clay Development Corp (CDC). Sirk
alledges, CDC is operating like a for profit outfit and is endangered the
entire operation due to actions of PamTaylor and Director Betty Stalnaker.

week, we've got a couple scheduled. Tuesday evening, 6pm, our School Board
folks will be meeting at HE WHite Elem. for their regular gathering. Might
be some action there as they announce who will be the $50,000.00 per year
Director of the newly received $750,000 grant for summer school. Clay High
Principal Cindy Willis has long been considered the odds on favorite.
The decision tomorrow night might not be so cut and dry since there were
more than the one applicant for the position.
Feb 17 pm Also, our one and only
Clay Development Corp. Board of Directors are scheduled to meet this Third
Wednesday of the month. No notice yet on whether the meeting will actually
take place.
Feb. 17 am Monday, President's
Day, was originally scheduled a day off for kids but was taken back into
the school calendar after many days off in Dec and Jan due to snow and
cold temps. This makes 6 days out of school due to winter conditions so
far. Don't worry kids, Monday does not have to be made up in June!

am, ambulance crew coming back from Ivydale, " Heading back to the station
on a solid sheet of ice." 1:24 am Call for a person not breathing,
Jan Care, responding from Gauley Bridge but a tree is blocking the road
near Independence Mountain. Clay Unit #17 responding from Ivydale but will
take an hour to get there due to road conditions. 1:27am JanCare got around
the tree and responding. Unit 19 also going on scene.

Feb. 17 am We made mention
in the Saturday post that attorney Barbara Schamberger had amended her
lawsuit against the County Commission and new Prosecutor Daniel Grindo.
The original suit deals with the process that the County Commission used
to hire a new County Prosecutor Dec 12 2002 after Jeff Davis resigned from
the elected spot Nov. 22 2002. Schamb contends that the CCC should have
followed state code and held an election for the vacancy. On Dec 27 2002,
Commissioner Tim "No Show" Butcher made a motion and Commissioner Sams
seconded the thing to NOT hold a special election for the Prosecutor. Commissioner
Mathew Bragg from the get go had been FOR holding an election for the slot
and has been a Schamberger supporter. The suit was filed in early Jan 2003
by the one time Asst. Prosecutor , Barbara Schamberger.
Feb. 17 am We now have some details
to add. Friday, Feb. 14, around 3 pm, Ms Schamberger amended her
suit. In addition to naming the sitting Commissioners and their choice
for Prosecutor, Daniel Grindo, Schamb has now brought Circuit
Court Judge Jack Alsop into the matter!!! Schamb is contending in the amended
petition, that a quorum of the County Commissioners met in secret, in Judge
Alsop's chambers ( around Nov. 16) and made their decision with the approval
of Alsop. Sheriff Fields, the county Democrat Chair, is also mentioned
as being a part of the behind the scenes, away from the public, stealthy
actions.
Feb. 17 am Without an agenda or
a meeting open to the public, Ms Schamb has added Open Meeting Law violations
to the other charges!!! So is this serious? Any "Sunshine Law" violation
is of course serious, but this amended complaint includes a Judge, Judge
Jack Alsop, his law clerk, attorney Daniel Grindo, and the Chairman of
the County Demorat party, Sheriff Harald Fields.
Feb. 17 am It is our understanding
that because of a strict judicial code of conduct, if Judge Alsop gave
an endorsement or campaigned for Grindo, muucho serious issues are raised.
Back in Dec 2002, during the selection process, Schamb contended Grindo
should not be considered for the spot due to conflict of interest issues
since he was employed by Alsop as his law clerk and Grindo could NOT be
considered for the opening since he was an employee of the courts!
Sams and Butcher did not listen at that time.
Feb. 17 am Also, the courts try
very hard to stay away from any hint of impropriety. If it proved that
a Judge sat down with our three blind mice and decided on who the CCC should
select for Prosecutor, the Judge could be in deep doo doo.
Feb. 17 am Open Meeting Law violations
again??? Do those boys ever learn? They received training by state
Asst. Attorney General Dawn Warfield in Nov. '98 and shortly thereafter,
were sued on violating the same law. Here just a couple years later,
it happening all over again and this time, the CCC's insurance provider
has said they won't cover the cost of the suit! Let's see now, we
don't have money to hire a county grant writer, we don't have money to
develop an industrial park, we don't have money to support an ambulance
service, we don't have money to provide an Asst. Prosecuting Attorney for
the county BUT we are now paying $125.00 per hour for a Charleston
attorney to defend our County Commission. Is that about right?
Feb. 17 am And Yes we're checking
on whether the James Allen Sams that filed for bankruptcy protection in
Charleston last week is our Commissioner Jimmy Sams.
Feb. 17 am The Courthouse
and banks are closed today for the holiday. Spend some time with the family.
Feb. 16 pm By 3pm Sunday,
Rt. 4 North of Spread Park was covered with slushy ice making driving almost
impossible. In other sections of the county, roads were just wet.
By 5pm, Gov. Bob Wise called for a state of emergency due to three feet
of snow falling in sections of the state. Here in Clayberry, no snow as
late as 7pm but ice! 7:24pm Feb. 16: mud slide blocks both lanes of Rt.
4 , Procious, WV.

Town of Clay was nearly impossible where two huge water backups covered
both lanes of roadway.

Daniel Grindo case. Word close say that an addition to the lawsuit was

at then Chief Judge Jack Alsop as one that should NOT have allowed Grindo
to be considered for the Prosecutor's position. Since the Courthouse
will be closed for the holiday, it'll be Tuesday before we get first hand
info.

Feb. 16 am Once again water customers
in the Wallback, Newton, Valley Fork went without water service due to
a leak in the Clay Roane PSD system. Finally, after three days of thirst
for many, with the efforts of the WV PSC, many locals including Commissioner
Jimmy Sams, the broken pipe was found in a pasture and fixed around 8pm
Tuesday night. The Boil Water Order continues until test results come back
clear. The Town of Clay BWO affecting the Two Run area was lifted Saturday.
Feb. 16 am The big winner last week
during Board of Review was one time Mayor of Clay and long time, now retired,
Assessor Joyce Gibson who successfully got three parcels of property reduced
by $1000s of dollars of tax assessments. Norman Wilson didn't far so well
Feb. 16 am In other County Commission
land activities: Local asked the CCC for help with Dominion Gas Company's
plans to bury a high pressure 30 inch gas transmission pipeline close to
area homes and Lizemore Elem.; General Ambulance Service , a for
profit company, asked the CCC to consider their operation for serving the
county if our local govt. run agency fails; and Clay Roane PSD Chair Melissa
Postelwait asked the CCC for $15,000.00 to pay off old debts including
the PSD's failure to pay employee holding taxes for 6 months. CCC President
Sams told Chair Postelwait to be fiscally responsible, make budget cuts,
live within their means was his message. Sams also announced
on Feb. 13th, that the citizen's of the county were loosing their one nice
meeting and hearing room , the County Commission room, to Family Law Court.
Feb. 16 am Ex Prosecutor Jeff
Davis' property made the auction block notice circle again this week. This
time, the holdings up for public auction is a home and land from a previous
marriage.
Feb. 16 am Thursday night's Clay
Roane PSD meeting (Feb. 13th) was a blow out. With lots of fired up customers
in attendance, answers were demanded: Why no water, why all the leaks,
why so long finding the leaks. Chair Postelwait and Commissioner Sams traded
words, Sams had asked Postelwait to resign earlier in the week. Postelwait
told all that she did not know about the PSD being behind paying mandated
employee benefit taxes until this week. With only $5400 on hand, the PSD,
after receiving three rate increase in 24 months, was in the red $30,000.00
Feb. 16 am For Clayberry locals,
Saturday Feb. 15 was a day to buy fuel, bring in extra food and drink.
A big time winter ice and snow storm was predicted!
Feb. 16 am All along this past week,
Dubbya continued beating his Daddy's war drum as flag waving Americans
took to the streets rallying for peace. A big cheese in DC told us to buy
duct tape and plastic to prevent deadly terrorist attack gases from entering
living rooms in America. Here in Clayberry, after years of trying to keep
lady bugs outdoors, we looked at each other and sighed.

Feb. 16 am And now something to
lighten the load: One day, while walking to the store, I passed by a Nursing
Home. On the front lawn were six old ladies laying naked on the grass.
I thought this was a bit unusual, but continued on my way to the
store. On my return trip, I passed the same Nursing Home and the same six
ladies were laying naked on the lawn. This time my curiosity got
the best of me. I went inside to talk to the manager. "Do you know there
are six ladies lying naked on your front lawn?" "Yes,"
he said. "They are retired prostitutes and they're having a
yard sale!"

Feb. 15 am And now for the update
on Clay Roane PSD's meeting held Thursday Feb. 13. Over 30 folks sat in
the peanut gallery as the Melissa Postelwait, Dave Saulsgiver, and Glen
Sutton conducted business. After months of not paying attention to
the operation, Clay Roane needs $3550.00 to pay the Town of Clay for water
purchased; $1243 to pay Bullard's Exxon; $503. for Elk Power; $701
for chemicals purchased; $1400 for Teel and Assoc.; $4494 for PEIA ( insurance);
$1725 for their contractor; $849 for the WV Tax Dept.; $1093 for Worker's
Comp and and and $11,455.88 for past due and now due Federal taxes. By
the end of the month the past due Fed tax bill will top $15000.00!!! All
those past due bills for the PSD has that has been granted three rate increase
in the last two years! AS of meeting time, Clay Roane had $5400 to their
name.
Feb. 15 am There's a peeing contest
going on between PSD Chair Melissa Postelwait and Commissioner Jimmy Sams.
During the PSD meeting, PSD attorney Tom Whittier advised that the CCC
has no say so in the operation of a PSD AND the PSD should not meddle in
the daily operation of the PSD. That, an employee manager should run the
whole shebang. After asking the CCC for financial help 5 hours earlier
in the day, after hearing Sams' responses, and comments, Postelwait said
they could get along without $ aid from the County Commission.
Feb. 15 am Many in the packed peanut
gallery were PSD customers that have been going without water off and on
for the last two weeks. They were NOT happy campers.
Although we'll give full details
of the 3 hour meeting in the Communicator... During a Special Clay Roane
PSD meeting two weeks ago, Clay Roane took over operation of Queen Shoals
PSD. WRONG! According to new information received Thursday's night, Queen
Shoals is still in operation as Clay Roane awaits an OK from higher ups.
Someone should have told Queen Shoals PSD Chair Tom Martin that his agency
was still in business. Martin came to the Courthouse this week and turned
in his paperwork as though QS PSD was all gone.
Feb. 15 am Citizen's of Clay
County, we're loosing a piece of OUR Courthouse. County Commission
plans to rent out the Commission room to the Family Law Court for $6 a
square foot along with portions of the long hallway between the Commission
room and the County Clerk's office. End result being, the citizen's
of Clay County will have one less place to hold a public meeting, hearing,
conference, etc. Of course, the interesting question is: Will the
Family Law Judge remove Jimmy Sams' 10 Commandment sign hanging on the
wall. Sams said he would NEVER take it down. That's NEVER NEVER NEVER!!!

the Communicator, we reported serious potty mouth by Mayor Jarrett apparently
directed at Commissioner Jimmy Sams. Early this week, Jarrett told us his
words were directed toward local attorney Kevin Duffy (not Sams) who some
time back failed to cough up $25.00 owed to Jarrett. New news! Since the
web posting, Duffy paid off his 25.00 debt and added an additional $5 to
boot.
Feb. 14 pm The old Kitchen restaurant
has been closed down for a month or more. On the window is notice that
new owners will will attempt another eatery business there known as Town
and Country.

County Commissioners Jimmy Sams and Peter Triplett met in regular session.
Over 30 people attended the 1 hour long + session. Here's a couple of highlights
Feb. 14 pm Several members of the
community appear ready to restart an animal neutering and spaying program.
$8000.00 is available for the effort which does NOT include neutering and
spaying of politicians.
Feb. 14 pm After being asked to
resign from the Clay Roane PSD Board by Commissioner Sams, Melissa Postelwait
attended the CCC and asked the elected ones for $15,000.00. Through mismanagement
and stupidity, Clay Roane has not paid their Federal employee taxes for
at least 6 months! A ticked off Sams told Postelwait, " At [your] meeting,
you'll have to find where to cut!" Sams expressed outrage that the PSD
has no one in charge of operations and was equally peed that the Board
was micro managing the operation on a day to day basis.
Feb. 14 pm Other stuff from the
13th, CCC gathering: Cathy Shuller informed the group that a number of
Clayonians are upset over Dominion Gas Company's plans to lay a new 30
inch high pressure gas line right beside homes and Lizemore Elementary
School. Over a year ago, Dominion's plans were provided the CCC and back
then, the gang expressed little concern for the dangers and compensation
issues surrounding such digging; and, General Ambulance asked the CCC to
come in, set up, and operate an ambulance service for the county.

Feb. 12 am The water leak
out Newton way was fixed last night around 8 pm. The water plant was run
all night in an attempt to refill the Ovapa tank. We reported the leak
was in the same place as the big one 10 days ago. According to Clay Roane
PSD Chair Postelwait, this recent break was in a a pasture but quite a
distance away from the earlier spot. We stand corrected

Feb. 12 am Feb. is the month to
go before County Commission's Board of Review. So far few have done so.
Yesterday, during minerals day, the big winner was past Mayor Joyce Gibson.
Gibson holds an interest in three parcels of minerals and asked for reductions
to each. And reduce they did. For Gibson and not present interested parties
assessed values were lowered from and to, went like this: $2507.00 to $586.00;
$833.00 to $138.00; $800 to $120.00; $1480.00 to 188.00; $824.00 to $188.00;
$1650.00 to 377.00; $799.00 to $624.00; $1073.00 to 416.00; $536.00 to
$208.00; $1073.00 to $415.00 and on and on. Didn't go so well for Norman
D Wilson who asked that he not be taxed for coal NOT under some of his
holdings. Wilson said the coal had been removed by J G Bradley in the 40's.
Wilson will continue to pay for something not there

Feb. 12 am We reported two weeks
ago that the local school system received a $750,000.00 grant to fund summer
school and such over the next three years. Out of those $ comes a Director's
position at $50,000.00 per year. With the $50,000 and an extra duty contract
of two, the Board office slot becomes very lucrative. The position is now
open for bid. Send in your thoughts on who will get the nod. Keep
in mind Jerry Linkiiinnnnnooooger retires in three years and the jockeying
for position is already in progress.

for tomorrow. At 2 pm is the regular County Commission meeting followed
by a 7pm encounter, also at the COurthouse by the Clay Roane PSD Board

Feb. 11 pm About 10 days ago, Mayor
Arthur Jarrett laid off the Town's only Cop. Last night Jarrett had three
nice big wooden owl carvings stolen from his property on Center Street.
Wife Bonnie has a $50.00 reward for the safe return of the 80 pound plus
all wood, hand carved owls. Others near Jarrett's home saw a dark colored
Jeep Wagoneer casing the place around 10 last night.
Feb. 11 pm In the latest edition
of the Communicator we reported the potty mouth from Mr. Jarrett during
the end of the Business Development Authority meeting Feb. 6th. Since Commissioner
Sams had just left the building, we thought Jarrett was talking about Sams.
WRONG! According to Mr. Jarrett, he was talking about local attorney
Kevin Duffy and a messy affair with the Widen Wiccans who had rented space
at Jarrett's historic Henry Clay Hotel. When the Wiccans left,
they left behind a lard bucket full of peee and an unpaid Hotel bill.
Jarrett is mad at Duffy over the affair.
Feb. 11 pm As for water service
being restored in Valley Fork, Wallback, Newton, Ovapa... as of 3 pm today
and according to Chief Water Operator Jennifer Traub, a water leak was
found past the Newton Store in a pasture bottom. Crews are currently trying
to repair the 6 inch line. By the way, the break is in the same place as
the one two weeks ago which left the area dry for several days.
Feb. 11 pm The Ovapa tank went dry
sometime late in the night after WV PSC's Dave Foster told crews
to open all the valves in the system. Foster's idea was to find the leak
quicker. On the down side, by opening all the service valves, the tank
went dry real quick. Early morning calls this morning revealed that Valley
Fork Elem. was completely without water service.
Feb. 11 pm Evening crews are running
the Procious water plant all night in an attempt to put some wa wa in the

in WV. Here is Clayberry, State Road employee Phillip Morris filed for
Clay Town Council office and paid the $5 fee. According to Helen Morris,
Phillip has retired. Word on the street has it that Mr. Mr. Morris will
not retire until April 2003.

the big time water leak in the Clay Roane PSD system has not been found.
Jennifer Traub, Bobby Burdette, Dale Deems, Dave Foster from WV PSC and
even Jimmy Sams have been walking the lines trying to find the break. As
for the busted water pump which feeds the Ovapa storage tank, Bobby Burdette
re-packed the seals and everything there is 100% again.

Commissioner Sams has asked Clay Roane PSD Chair Melissa Postelwait to
resign! Seems there's a rift between the two over paying Dale Deems
overtime while looking for the leak. When Sams asked to use the PSD truck
Sunday and Monday, Postelwait said No way. Sams was seen driving his own
vehicle around the county in pursuit of the pesky leak. As for using Deems
on OT, Sams has that issue posted on this Thursday's Commission agenda
and it's expected that Deems, who went ahead and worked the last couple
of days, will be paid out of Coal Severance funds.
Feb. 11 am So what else is going
on in Clay Roane PSD land. Postelwait has filed a formal complaint on new
to the Board Dave Saulsgiver. Saulsgiver worked as Chief Water Operator
for over 17 years for the PSD and during that time amassed a bunch of baggage.
During PSD hearings on the matters of controversy, Saulsgiver came out
teflon coated and clean. According to Dave, he was given Board permission

Feb. 10 pm Those Mingo
County Commissioners that were indicted last week for not paying employee
taxes have now plead not guilty.
Feb. 10 pm Now this gets
confusing so pay attention. On Dec 12th or so, Barbara Schamberger filed
a lawsuit against the Clayberry Bank in an attempt to regain ownership
of the Business Development Authority property by the BDA. In early Jan
2003, that lawsuit was amended to include Wayne and Sandy King as well
as JD ( I like wearing orange) Morris. Last Monday Judge Facemire tossed
the suit because both Schamberger and bank attorney Kevin Duffy were "dilly
dallying" around. Last Monday's hearing was called by Duffy because
Schamb hadn't crossed every T and dotted every i. Facemire allowed Schamb
to refile within five days. She did just that, and did it in 4 days. Get
this. The new suit once again includes Wayne and Sandy King as well as
JD.

of another system break. Additionally, the Ovapa booster pump went on the
fritz. The Ovapa tank is nearly dry! Jennifer Traub, Dale Deems, Bobby
Burdette and even Commissioner Sams were out Sunday looking for the broken
pipe. Snoops from Charleston were called in to help locate the problem.

that Clay Roane PSD took over Queen Shoals PSD last Friday. Queen Shoals
wasn't paying its bills. Word is just seeping out that Clay Roane PSD has
NOT paid its quarterly employees taxes to the Feds. They're waaaaaaaaaaay
behind. So how serious is this. Last Wednesday, the Mingo County Commission
was indicted for similar violations

petition to remove Jimmy Sams from office now has over 100 names affixed.
No word on the Sheriff's removal petition. Some are afraid to sign that
petition, retribution thoughts. Last week, on Thursday, Sheriff Fields
commented that there would NOT be any retribution from his office for those
signing the Remove Fields petition

was. The great arm of justice bit JD Morris in the hiney last Monday. He
was sentenced to 18 months in the slammer. The County watched as regional
news covered the event. Our long time political top dog is now doo doo.
Feb. 9 am Tuesday brought it
out in the open that the Town of Clay is Copless while the CAEZ is in possession
of Filcon's equipment without the Judge's permission. The Town is defenseless
and CAEZ is in a real mess and in jeopardy of blowing the entire court
case bid to get some of their $140,000.00 in loan money back.
Feb. 9 am Thursday's Business
Development sent member and County Commissioner Jimmy Sams stomping his
feet all the way home as he resigned his spot after the BDA REFUSED to
fire attorney Barbara Schamberger. Thursday rounded out with Queen Shoals
PSD shut down and Clay Roane PSD taking over the operation. Oddly enough,
it has always been Clay Roane in financial and managerial troubles.

the WV Public Service Commission (PSC) used strong arm tactics trying to
force the Town of Clay out of the water business. A year ago, the Town
pulled a flanking move and said, If you want our water plant, you gotta
take the sewer plant too. After regaining their composure, again, the PSC
strong armed to get this shoved down people's throats. Today we can see,
the Town out foxed the Charleston gang and strong words have been taken

are GONE. Under the stealthy hand of the WV Public Service Commission,
the Queen Shoals PSD was shut down Thursday Feb. 6 and last night during
a Special Clay Roane PSD meeting, Clay Roane took over the entire operation.
You now have NO voice on the water Board that has some of the highest water
rates in the state.

, the County Commission held another Board of Review for anyone to come

of hokus pokus in Clay? There's lawsuits flying all around the state. Down
in Mingo County, all the County Commissioners and the County Clerk have
been indicted. In Preston County, ex Asst. School Superintendent David
Friend is suing the Board for their bad mouthing his name while interviewing
for another position. Friend who is now Hampshire County Superintendent
of Schools, seeks compensatory and punitive damage awards.

Feb. 5 am Monday was a big
day as JD Morris was sentenced to prison. Sure don't want to forget other
action that happened Monday. Like... School Superintendent Jerry Linkinnnooogggger
agreed to a new three year employment contract. How would you like to make
$69,000 a year? School Board members Fran King and Scott Legg are
in a tiff over coaching duties at Clay High. Looks like they're on opposite
sides of the table over the High School Girl's Basketball coach.
During the meeting, Gene King referred to the good old days when none of
the Board bickering made into public meetings. Full details this Friday

Council met. Discussion came up on the Town
laying off cop Tommy Myers. Word had it that Myers was laid off for lack
of $$$. Discussion centered on other issues surrounding the officer.
Feb. 5 am Central Appalachia Empowerment
Zone (CAEZ) also met Tuesday. Big time discussion on firing their attorney
over performance in their court battle to regain Filcon Inc. equipment.
After lengthy discussions, it came out, the court battle is in a mess,
the Filcon equipment they took possession of from the Sheriff, really doesn't
belong to them and the Court Order allowing CAEZ to take possession, was
NEVER signed by Judge Alsop. It appears that the entire case may be in
jeopardy. Who would loose out? That's right, you the taxpayer.
Feb. 5 am The Health Clinic over
at Newton will be closing down Feb. 28, 2003. The CAEZ backed medical
provider received $33,000.00 from the CAEZ a couple years back.

ex Prosecutor Jeff Davis to get tangled up in a civil case. Filed this

County Commission meets at 10 am to hear from anyone in the county that
thinks their taxes are too high. Also at 10 is an "informal" meeting
at the Procious Water Plant between Clay Roane PSD, Queen Shoals PSD, and
the WV Public Service Commission. Discussions are on the folding of QSPSD
and the take over of the water provider by Clay Roane.

big day for Clay County. For little Clayberry to have a man ascend to state
wide office ( State School Board), is big news. Likewise to see that same
king pin fall from power and be sentenced to prison, is even bigger news.
We're talking of Jimmy D Morris. While it is true JD received the lightest
sentence possible from the Federal Judge, our king pin was convicted of
a felony and will be locked up. Justice , albeit light, has been
served to even the county's most influential person.

empty courtroom ( certainly no wife or daughter present), the quivering
voice of once the most powerful man in Clay County, J D Morris, remarked
that he had embarrassed his wife, daughter and the School Board. No mention
was made by Morris of the violated trust of everyone in the County
of Clay.
Feb. 3 pm After attorney Wayne
King asked for a lighter sentence, Judge Haden imposed the lightest sentence
possible on JD, 18 months, 4 years supervised probation, and no fine. Here's
a good part, Federal Prosecutors commented that JD had been very cooperative
in their investigation of "others". Others? Bet there's a bunch
of Clayonians with bunched up shorts tonight. Remember Johnny Cochran's
" If it don't fit you must acquit" bit? Here's one for Clay County:

finest suit, JD slithering out the back door of the Federal building ,
avoiding the public, as he was whisked away in his blue Cadillac.

ex Senator Randy Schoonover was given $2700.00 and spent 18 months in prison.
JD Morris stole at least $136,000.00 from the citizen's of Clayberry and
got 18 months. Hmmmmmmmmmmmmm...

action today. In Judge Rick Facemire's Court, Clay County Bank attorney
Kevin Duffy asked that the lawsuit against the bank (brought by the Business
Development Authority) be dismissed. Nothing doing was the end decision
with commentary coming from the Judge on both parties " dilly dallying".
Facemire also commented that he wanted a speedy resolution. The BDA
is represented by attorney Barbara Schamberger. County Commissioner Jimmy
Sams wants Schamberger removed from the BDA case. Nice write up coming
this Friday on this case too!

5pm, in the Clay Middle School gym, Jr. Varsity vs Nicholas County, 10
seconds remaining, the score is tied 37 - 37. Jesse Street steals the ball
, goes down and is fouled, 2 shots coming him. He makes one, 38 - 37.

the fate for Nicholas, CMS player Matthew Carte is fouled and sinks both

Feb. 3 am Two big time Court events
today. The biggy is the sentencing of State School Board President JD Morris
in Judge Haden's Federal court room at 10:30 am this morning. Here
at the Clay Courthouse, attorney Kevin Duffy is asking the Court to dismiss
the lawsuit brought by the Business Development Authority against Duffy's
client, the Clay County Bank. That action begins around 9:30 according
to the Circuit Clerk's office. Interesting enough, while the Clayberry
Bank wants shed of the lawsuit, Commissioner Sams wants shed of the BDA's
attorney, Barbara Schamberger. The BDA wants their $90,000.00 in
taxpayer paid for land back from the sticky fingers of the questionably
lien challenged Bank
Feb. 3 am Many of you participated
in the online survey concerning predictions on how much time Morris will
get this morning. In addition to predictions, some of you included commentary.
One such comment went like this: J.D.Morris might get one( 1 ) day
in jail and maybe a year of probation . If he gets any fine it will never
amount to what he has done to other people--whose trust was broken in him
as a pillar of the community and the kids that looked up to him. The school
board he served on. The people who needed help and he refused and at the
same time was helping his self to other peoples money. That is what happens
when people get greedy and money hungry--that is what we call living above
your pocket book. That emailer seemed to sum it all up pretty nicely

from the Federal building, we'll post the JD news. Guess is, around 2:30pm
today. Keep in mind, the sentencing could be delayed again.
Feb. 3 am Queen Shoals PSD from
the get go, has been a quiet little water service provider for many years.
Serving 130 some customers in the Southern end of the county, QS PSD is
often forgot about. Not so now as the one time resilient agency appears
to be closing up shop and turning it's obligations over to the PSD which
supplied QS PSD with treated water, Clay Roane PSD. A Special meeting of
Clay Roane's Board will meet this week.
Feb. 3 am Did we mention that Clay
Roane's newest appointed Board member, Dave Saulsgiver, has NOT been sworn
in? Been three weeks so far. Sort of like the ole olive branch ploy, when
Clay Roane takes over QS PSD, one of those Boardsters could be added to
the Clay Roane Board in place of the Saulsgiver to give the Queen Shoals
area customers some identity.

are still glued to their TV sets watching the continued coverage of the
Columbia shuttle disaster. With funeral services coming mid week, Clayberry
is maintaining a quiet pace now.

spent a week in the winter dulls as cold winter weather warmed a tad and
the rain set in. Much of the frozen , snow covered earth turned back to

With no doubt left, no matter what, Dubya is sending American's into harms'
way. Even if Saddamn bailed out today, soldiers will still be in Iraq going

coupled with watching footage of the exploding shuttle left little to smile

asked for a $100,000 bail out grant to pay off, cover the tracks, a like
amount loan left over from the days of the Ambulance Authority. Additionally,
the CCC sold off three ambulances reaping just $1400.00 for their efforts.

One time pillar of the community JD Morris is scheduled to be se>ore Judge
Haden in Charleston. ALmost exactly 1/2 of our respondents felt that Morris
would receive NO jail time. The other half of our polling group averaged
out to 18 months in jail and probation ( up to 5 years). As for the fine
involved, high number was $55,000.00 with 10 people commented that Morris
would receive no fine. 5 people did not provide the fine info when responding.

5 years jail time with Morris getting out after 3 years; 5 years probation;

clickers. The most powerful man in Clayberry, in his brick home out Ovapa
way, JD Morris, is sitting there knowing he has just 48 hours of freedom
available him. He's preparing to take a trip requiring no suitcases, toothbrush,
not even a clean change of underwear. His days of eating out every night

public hearing was held to gather comments from those who have suffered
flood loss. Guess how many showed for the input session? None!

is proudly strutting around after receiving word that a $750,000.00 grant
has been Oked; The grant $250.000.00 for three years will finance after
school programs, Camp Mustang, and Summer School activities. Kenneth Tanner
